You ("Member") permit Carclean, Inc. ("Carclean") to enroll you in the Unlimited Wash Program, (" the Program"), and to be charged as per this agreement, according to the prevailing rate schedule. After the initial monthly rate has been paid, the Program entitles member's enrolled vehicle to Program Benefits for 30 continuous 24-hour days, beginning upon the date and time shown upon the enrollment payment receipt. Enrollment in the program is non-refundable after the time at which any vehicle received its initial service under the program.
The Unlimited Wash Program provides unlimited prepaid washes, of the type shown and for the time period purchased, at Carclean, Inc. dba Fairway Carwash, 3105 Peachtree Industrial Boulevard, ONLY.
The Program is available ONLY for cars, SUVs, light trucks, minivans and other passenger vehicles. This program is NOT available to any vehicles for hire (commercial vehicles) at the prevailing rate. Commercial pricing & terms will be provided upon request.
The Program provides unlimited washes for the "group leader" vehicle listed on the Automatic Recharge Authorization (â€œARAâ€), identified by its tag number, make, and model. Each additional vehicle will also be identified by its tag number, make, and model. No vehicle shall receive a free wash redemption unless it is enrolled in a plan at the time of service. All vehicles enrolled under a single contract must be enrolled for the same service, and term, and must be billed on the same single monthly billing.
AUTHORIZATION: By enrolling in the Program, Member agrees to be charged the Monthly Rate shown on their ARA indefinitely, unless discontinued as per the Discontinuation Procedures provided herein.
If Member, or anyone driving Member's enrolled vehicle, shall incur any additional charges not covered under this Agreement, payment is due at the time of service.
DENIED, CANCELLED, EXPIRED CARDS & LATE FEES:
If a credit card is denied for any monthly recharge, Carclean will attempt to charge the credit card for three days following the initial rebill date, at the Monthly Rate specified per the ARA. A denied, cancelled or expired card does not constitute discontinuation, and Member shall be responsible for each and all Monthly Rates until such time that the enrollment has been discontinued.
HOURS / CLOSING POLICY:
Carclean, Inc. specifically reserves the right to discontinue providing wash services during periods of severe weather, including lightning, heavy rain, strong winds, tornado warnings, and other meteorological conditions, as determined by the National Weather Center or by local authorities. Such interruption shall not constitute reason for refund, in part or in whole.
To discontinue enrollment in the Program, please 1.) Obtain a discontinuation form from Carclean, 2.) Complete entire form and 3.) a. Return the form to Carclean in person, at which time you will receive a countersigned, dated acknowledgement, or b. Return the form to Carclean via certified U.S. mail, in which case you MUST save your proof of service receipt. No other means of transmitting a discontinuation request shall be deemed valid, specifically including electronic means. All discontinuation requests must be received no less than 7 days prior to the Monthly Renewal date on the ARA.
Discontinuation does not entitle Member to full or partial refund or store credit for any reason. There are no refunds for any charges made in accordance with this Agreement. Member must render full payment for unpaid services or indebtedness prior to discontinuation. Upon discontinuation, all Program Benefits are immediately terminated. Frequency of usage of benefits, or lack of usage, does not constitute grounds for automatic discontinuation.
Members may change their single enrolled vehicle at any time. There is no charge for a single vehicle change, provided that a Member does not request another vehicle change again until the new vehicle has paid three additional Monthly Rate renewal charges. Members may change their multiple enrolled vehicles at any time. provided that during any renewal month of this agreement only one vehicle substitution is requested. Each additional substitution shall be billed at $25.
This Agreement, including all its terms, conditions, fees, and offers, are subject to change at any time. All such changes shall be sent to Members by their e-mail addresses provided, and posted in a conspicuous manner at Carclean's customer service counter, for at least 30 days prior to the effective date of any such change. No such change in terms or pricing shall be retroactive, or shall constitute grounds for the full or partial refund of any prior Monthly Rate paid.
